Maryland is appealing a federal judge’s ruling that one of its requirements to obtain a handgun permit is unconstitutional.

U.S. District Judge Benson Everett Legg ruled last month that the state’s requirement that people show a “good and substantial reason” to get a permit infringed on citizens’ Second Amendment right to bear arms.

As I note in the comments: Since so many people are killed in car accidents, shouldn’t you show a good and substantial reason to have a driver’s license?

    Operating a moving vehicle isn’t even an enumerated right under the Constitution. The state could actually do that if they wanted to, and the Constitution wouldn’t have a damn thing to say about it. (Of course, there’s other reasons than simply being unconstitutional that laws can be struck down … this one would probably fall under the category of unduly burdensome at a minimum, and then there’d of course be equal protection challenges, when the DMV manager’s friends and the sherrif’s campaign donors all seem to get licenses with no problem …

    1. Rights need not be enumerated under the Constitution to be reserved to the people, vice the states. Though just where the line is between those two… well, there’s a question!

    2. True, but the lack of an enumerated right reserved to the people with respect to operating a moving vehicle means that strict (or even intermediate) scrutiny will almost certainly not apply. To be perfectly honest, the state doesn’t have to work very hard to come up with a “compelling interest” in regulating vehicle use, and since no increased level of scrutiny applies … so long as the regulation serves some clear purpose related to the stated “compelling interest,” then it’s likely to be no big deal.

  2. Personally, I think a politician should have to show good reason to run for office, as well as produce a certificate of mental competency. The last would eliminate the overwhelming majority of the leftists.
